Welcome to St. John’s Football Club (“SJFC”). By using this website, the related mobile website, and the mobile application (collectively, the “Websites”), you agree to be bound by these Terms of Service (this “Terms of Service” or “Agreement”), whether or not you register as a member of St. John's Football Club. Participation in our programs, events, and activities also constitutes your agreement to these Terms of Service.. These terms are designed to ensure the safety, respect, and well-being of all participants and to maintain the integrity and reputation of SJFC.
2. Illegal Use of the Site or Material
This outlines the policies regarding the illegal use of the SJFC website, related mobile website, and mobile application (collectively, the “Websites”), as well as any material associated with SJFC. By accessing and using the Websites, you agree to comply with all applicable laws and regulations and to refrain from any illegal activities that could compromise the integrity, security, and reputation of SJFC.
2.1 Prohibited Activities
Users of the SJFC Websites are strictly prohibited from engaging in any of the following illegal activities:
Unauthorized Access: Attempting to gain unauthorized access to any portion or feature of the Websites, other user accounts, or any other systems or networks connected to the Websites.

Fraudulent Activities: Engaging in any fraudulent activities, including but not limited to:
Phishing: Attempting to acquire sensitive information such as usernames, passwords, or credit card details by masquerading as a trustworthy entity.
Identity Theft: Using another person’s identity or personal information without their consent for illegal purposes.
Payment Fraud: Using stolen credit card information, fake payment methods, or other forms of financial fraud.
Illegal Commerce: Using the Websites to engage in any illegal trade or commerce, including the sale or distribution of illegal substances, counterfeit goods, or unauthorized products.
Harassment and Stalking: Using the Websites to harass, stalk, or threaten others, or to violate the privacy rights of any individual.
2.2. User Responsibility

2.3. Consequences for Violations
Violations of this addendum will result in immediate and severe consequences, including but not limited to:
Account Suspension or Termination: SJFC reserves the right to suspend or terminate your access to the Websites without prior notice if you engage in any illegal activities.
Legal Action: SJFC will cooperate fully with law enforcement authorities in investigating any illegal activities. This may include sharing user information, content, and activity logs with the relevant authorities.
Civil Liability: Users may be held financially responsible for any damages resulting from their illegal activities on the Websites. This includes costs associated with legal action, data recovery, security measures, and any other expenses incurred by SJFC as a result of the violation.
Permanent Ban: Users found engaging in illegal activities may be permanently banned from using SJFC services, including any future iterations of the Websites or related platforms.
2.4. Monitoring and Enforcement
SJFC reserves the right to monitor all activity on its Websites to ensure compliance with this addendum. This includes:
Content Review: Reviewing, filtering, or removing any content that violates this addendum or the SJFC Terms of Service. SJFC may do so at its discretion and without prior notice to the user.

If you become aware of any illegal activities or violations of this addendum, you must report them immediately to SJFC through the following channels:
Email Reporting: Send an email to the designated SJFC compliance officer or the legal department detailing the nature of the violation, including any relevant evidence or information.
Anonymous Reporting: If you prefer to report violations anonymously, you may do so through any available anonymous reporting tools provided by SJFC. Please provide as much detail as possible to assist in the investigation.
Law Enforcement: In cases of immediate danger or severe criminal activity, contact local law enforcement directly and notify SJFC as soon as possible.
3. Use of Photos and Media
3.1 Consent for Media Use
By participating in SJFC activities, you grant SJFC permission to take and use photographs, video recordings, or other media that may include your image or the image of your child (if applicable) for promotional and marketing purposes.
These materials may be used in various formats, including but not limited to the SJFC website, social media channels, newsletters, and other marketing materials.
No compensation will be provided for the use of these images, and SJFC retains all rights to these materials.
3.2 Opt-Out Option
If you do not wish for your image or your child’s image to be used in any media, please notify SJFC in writing. The club will make every effort to honor such requests.
4. Responsibility for Personal Items
SJFC is not responsible for any damage to, or loss of, personal items brought to training sessions, matches, or other club events.
Participants are advised to keep their personal belongings secure and to avoid bringing valuable items to SJFC activities.
5. Limitation of Liability
5.1. Introduction
This Limitation of Liability Clause outlines the extent to which St. John’s Football Club (SJFC), including its directors, officers, employees, agents, affiliates, and partners, will be held responsible for any damages, losses, or injuries that may arise from your use of the SJFC website, related mobile website, mobile application (collectively, the “Websites”), and participation in any SJFC programs, events, or activities. By accessing and using the Websites and participating in SJFC activities, you agree to the terms of this clause.
5.2. General Limitation of Liability
Scope of Liability: SJFC and its affiliates will not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, resulting from:
Your use or inability to use the Websites.
Unauthorized access to or alteration of your transmissions or data.
Statements or conduct of any third party on the Websites.
Any other matter relating to the Websites, SJFC programs, events, or activities.

5.3. Specific Limitation of Liability for Website Use
Website Content and Functionality: SJFC makes no representations or warranties about the accuracy, completeness, or reliability of the content available on the Websites. You acknowledge and agree that your use of the Websites and any material or content downloaded or otherwise obtained through the Websites is at your own discretion and risk. SJFC will not be liable for any damage to your computer system or loss of data that results from the download or use of any such material.
Third-Party Links and Services: The Websites may contain links to third-party websites or services that are not owned or controlled by SJFC. SJFC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that SJFC will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party websites or services.
Technical Issues: SJFC does not guarantee that the Websites will be available at all times or that access will be uninterrupted, secure, or error-free. SJFC will not be liable for any damages or losses resulting from technical issues, including but not limited to server outages, data transmission errors, or website maintenance.
5.4. Limitation of Liability for Programs, Events, and Activities
Assumption of Risk: Participation in SJFC programs, events, and activities may involve inherent risks, including but not limited to physical injury, illness, or property damage. By participating, you acknowledge and voluntarily assume all risks associated with such activities, whether caused by the actions or omissions of SJFC or others.
Medical and Insurance Liability: SJFC recommends that all participants maintain appropriate medical insurance coverage. SJFC will not be liable for any medical expenses, loss of income, or other damages arising from injuries sustained during participation in SJFC programs, events, or activities. Participants are responsible for their own medical costs and any other related expenses.
Release of Liability: To the fullest extent permitted by law, you agree to release, discharge, and hold harmless SJFC, its directors, officers, employees, agents, affiliates, and partners from any and all claims, demands, or causes of action, including but not limited to claims for personal injury, property damage, or wrongful death, arising out of or in connection with your participation in SJFC programs, events, or activities, whether caused by the negligence of SJFC or otherwise.
5.5. Limitation of Liability for User-Generated Content
Content Responsibility: SJFC is not responsible for any user-generated content posted on the Websites, including but not limited to comments, reviews, or media uploads. Users are solely responsible for the content they post and must ensure that such content complies with all applicable laws and regulations.
Content Removal: SJFC reserves the right, but is not obligated, to monitor, edit, or remove any user-generated content that it deems inappropriate, offensive, or in violation of the Terms of Service. SJFC will not be liable for any damages resulting from the removal or failure to remove such content.
5.6. Limitation of Liability for Force Majeure Events
Force Majeure: SJFC will not be liable for any failure to perform its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, pandemics, supply shortages, natural disasters, or any other event commonly referred to as "force majeure." In the event of such an occurrence, SJFC’s obligations will be suspended for the duration of the event, and SJFC will make reasonable efforts to resume its obligations as soon as possible.
5.7. Limitation of Liability for Indemnification
Indemnification: You agree to indemnify, defend, and hold harmless SJFC and its directors, officers, employees, agents, affiliates, and partners from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:Your access to or use of the Websites.
Your violation of any term of the SJFC Terms of Service.
Your violation of any third-party right, including without limitation any intellectual property, property, or privacy right.
Any claim that your use of the Websites caused damage to a third party.
5.8. Limitation of Liability for Representations and Warranties
Disclaimer of Warranties: The Websites, SJFC programs, events, and activities are provided on an "as is" and "as available" basis without any representations or warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and availability. SJFC does not warrant that the Websites or any associated services will be secure, error-free, or meet your specific requirements.
5.9. Governing Law and Jurisdiction
Governing Law: This Limitation of Liability Clause, along with the SJFC Terms of Service, will be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Jurisdiction: Any disputes arising out of or relating to this Limitation of Liability Clause or the SJFC Terms of Service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, and you hereby consent to the jurisdiction of such courts.
5.10. Severability
Severability: If any provision of this Limitation of Liability Clause is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid, illegal, or unenforceable provision will be deemed modified to the extent necessary to make it enforceable, and if it cannot be so modified, it will be severed from this clause without affecting the validity and enforceability of the remaining provisions.
6. Strict Adherence to the Code of Conduct Policy
6.1. Introduction
St. John’s Football Club (SJFC) is committed to fostering a positive, respectful, and safe environment for all participants, including players, coaches, staff, parents, and visitors. To maintain this standard, strict adherence to the SJFC Code of Conduct Policy is required. This section outlines the importance of complying with the Code of Conduct and the consequences of failing to do so.
6.2. Mandatory Compliance
Obligatory Adherence: All members of the SJFC community, including players, coaches, staff, parents, guardians, and visitors, are required to fully comply with the Code of Conduct Policy at all times. This includes but is not limited to:
Behavior: Displaying respectful, sportsmanlike conduct on and off the field, in alignment with the values and principles outlined in the Code of Conduct.
Communication: Using respectful and appropriate language in all forms of communication, including in-person interactions, written communication, and digital platforms.
Safety: Adhering to all safety guidelines and procedures to ensure the well-being of all participants.
Integrity: Acting with honesty, fairness, and integrity in all interactions associated with SJFC.
Acknowledgment of Policy: All participants, including players and their guardians, must acknowledge that they have read, understood, and agree to comply with the SJFC Code of Conduct Policy as a condition of participation in SJFC programs, events, and activities.
6.3. Monitoring and Enforcement
Monitoring Compliance: SJFC reserves the right to monitor participant behavior and communication to ensure compliance with the Code of Conduct. This may include observation of practices, games, events, and any official or unofficial communication related to SJFC activities.
Reporting Violations: Participants, parents, and staff are encouraged to report any violations of the Code of Conduct to SJFC administration. Reports can be made confidentially and will be investigated promptly and thoroughly.
6.4. Consequences of Non-Compliance
Disciplinary Actions: Failure to adhere to the SJFC Code of Conduct Policy will result in disciplinary actions, which may include but are not limited to:
Warnings: Verbal or written warnings for minor infractions or first-time offenses.
Suspension: Temporary suspension from participation in SJFC programs, events, or activities for more serious or repeated violations.
Expulsion: Permanent removal from SJFC programs, events, or activities for severe or persistent breaches of the Code of Conduct.
No Refund Policy: Participants who are suspended or expelled due to violations of the Code of Conduct are not entitled to any refunds for fees paid for programs, events, or activities.
Impact on Opportunities: Violations of the Code of Conduct may also impact opportunities for participation in future SJFC activities, including eligibility for team selection, scholarships, or advancement within the club.
6.5. Appeal Process
Right to Appeal: Participants who are subject to disciplinary actions have the right to appeal the decision. Appeals must be submitted in writing to the SJFC disciplinary committee within a specified timeframe following the disciplinary action.
Review Process: The SJFC disciplinary committee will review the appeal, considering all relevant information and circumstances. The committee’s decision will be final and binding.
6.6. Commitment to a Positive Environment
Promotion of Positive Behavior: SJFC is dedicated to promoting a culture of respect, fairness, and positivity. All participants are encouraged to lead by example, demonstrating the values of teamwork, respect, and good sportsmanship.
Support for Compliance: SJFC provides resources, training, and support to help participants understand and adhere to the Code of Conduct. This includes regular reminders of expected behavior and clear communication of the standards to be upheld.
7. Compliance and Enforcement
Failure to adhere to this Terms of Service may result in disciplinary action, including but not limited to warnings, suspension, or expulsion from the club.
SJFC reserves the right to update or amend this Terms of Service at any time. All members will be notified of any changes.
