1. Introduction
Welcome to St. John’s Football Club (“SJFC”). These Terms of Service (“Terms” or “Agreement”) govern your use of our website, related mobile websites, mobile application (collectively, the “Websites”), and participation in any SJFC programs, events, or activities (“SJFC Activities”).
By accessing or using the Websites, registering for, or participating in SJFC Activities, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.
If the participant is under the age of 18, the parent or legal guardian confirms they have the legal authority to bind the participant to these Terms and agrees to be bound both personally and on behalf of the participant.
These Terms are designed to ensure the safety, respect, and well-being of all participants, and to protect the integrity, reputation, and operations of SJFC.
2. Illegal Use of the Websites or SJFC Materials
2.1 Prohibited Activities
You agree not to engage in any illegal or prohibited activities, including but not limited to:
Unauthorized Access: Attempting to access restricted areas of the Websites or related systems.
Malware or Harmful Code: Uploading or distributing viruses, worms, or malicious software.
Illegal Content: Including but not limited to copyright infringement, exploitation of minors, hate speech, promotion of terrorism, or other unlawful material.
Fraudulent Activities: Such as phishing, identity theft, or payment fraud.
Illegal Commerce: Using SJFC platforms for unlawful sales or distribution of prohibited goods.
Harassment or Stalking: Threatening, harassing, or violating another’s privacy.
Automated Abuse: Bots, scraping, bulk downloads, or circumventing security controls.
2.2 User Responsibilities
Compliance: You are responsible for complying with all applicable laws and these Terms.
Account Security: Maintain confidentiality of login credentials.
Reporting: Report suspected illegal activity to SJFC immediately.
2.3 Consequences
SJFC may:
Suspend or terminate accounts without notice.
Cooperate fully with law enforcement.
Pursue civil claims for damages, including recovery of costs and attorney’s fees.
Permanently ban offenders from SJFC Activities.
3. Use of Photos and Media
By participating in SJFC Activities, you grant SJFC a perpetual, royalty-free right to use photographs, video, and other media of you or your minor child for marketing, promotional, or educational purposes in any format. No compensation will be provided.
Opt-Out: Written notice must be received prior to participation. SJFC cannot control third-party captures at public venues.
4. Responsibility for Personal Items
SJFC is not responsible for loss, theft, or damage to personal property. Supervision is provided only during scheduled activity times; parents/guardians remain responsible before check-in and after dismissal.
5. Limitation of Liability, Assumption of Risk, and Waiver of Claims
5.1 Assumption of Risk
Participation in SJFC Activities involves inherent risks, including but not limited to physical contact, collisions, falls, weather hazards, uneven surfaces, communicable diseases, transportation-related risks, and actions or omissions of others. By participating, you knowingly and voluntarily assume all risks, whether foreseeable or unforeseeable.
5.2 Waiver and Release (Adults)
To the fullest extent permitted by law, you waive, release, and forever discharge SJFC, its officers, directors, employees, contractors, volunteers, and affiliates from any and all claims, demands, or causes of action (including those arising from negligence or gross negligence) related to your participation in SJFC Activities. This waiver survives termination of participation.
5.3 Florida Minor Participant Waiver (Statutory Notice)
WARNING: UNDER FLORIDA LAW, AN INDIVIDUAL WHO SIGNS A WAIVER OF INHERENT RISKS IS PRESUMED TO HAVE ASSUMED THOSE RISKS AND IS BARRED FROM RECOVERING DAMAGES RESULTING FROM THOSE RISKS. INHERENT RISKS ARE THOSE DANGERS OR CONDITIONS THAT ARE AN INTEGRAL PART OF THE SPORT OR ACTIVITY. THIS WAIVER DOES NOT APPLY TO GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT.
Parent/Guardian acknowledges they have read and understood this statutory notice and voluntarily agree to its terms on behalf of the minor participant.
5.4 No Medical Liability
You are responsible for obtaining and maintaining appropriate medical insurance. SJFC is not liable for medical expenses, lost income, or related costs.
5.5 Consent to Emergency Care
If a parent/guardian cannot be reached, SJFC staff/volunteers are authorized to obtain emergency care, including transportation, in good faith. This does not create a duty to provide care.
5.6 Website Disclaimer & Third-Party Links
The Websites are provided “as is.” SJFC is not responsible for third-party sites or services accessed through its platforms.
5.7 Force Majeure
SJFC is not liable for disruptions caused by acts beyond its control, including weather, field closures, pandemics, or government orders. No refunds, credits, or make-ups are guaranteed in these circumstances.
6. Indemnification and Enforcement Costs
You agree to indemnify, defend, and hold harmless SJFC from any claims, damages, costs, and attorney’s fees arising from your or your minor child’s participation or your breach of these Terms. This obligation applies regardless of dispute outcome.
If SJFC takes legal action to enforce these Terms, you agree to reimburse all enforcement costs.
7. Code of Conduct Compliance
7.1 Mandatory Compliance
All participants, parents, coaches, and visitors must follow the SJFC Code of Conduct, including respectful behavior, adherence to safety rules, and appropriate communication.
7.2 Enforcement
SJFC may issue warnings, suspend, or expel participants for violations—with or without cause and without refund.
8. Athlete Safety & Compliance
Background Screening: All coaches, staff, and volunteers are subject to background screening in accordance with the policies of SJFC’s governing or affiliate organization. SJFC reserves the right, at its sole discretion, to implement additional screening measures — including but not limited to state and national fingerprint-based checks — for any role or individual at any time.
Concussion Policy: Annual informed consent is required; removal from play on suspicion; medical clearance before return.
SafeSport & MAAPP: SJFC adopts and enforces SafeSport and MAAPP guidelines, including mandatory reporting of abuse and communication boundaries.
9. Team Placement & Playing Time
Roster spots, positions, and playing time are determined solely by SJFC technical staff. No guarantees are made and decisions are final.
10. Travel, Facilities & Third-Party Events
Travel and lodging are at your own risk. SJFC is not responsible for conditions at third-party facilities or for cancellations by outside organizers.
11. Weather & Cancellations
Sessions may be altered or cancelled due to weather or safety concerns. Make-ups are not guaranteed. Refunds are not provided for these circumstances.
12. Payments, Refunds & Chargebacks
Registration/tryout fees are non-refundable.
No refunds for withdrawal, suspension, injury, or schedule changes.
Chargebacks result in immediate suspension until resolved; recovery costs apply.
13. Privacy & Data Protection (COPPA Compliance)
Accounts for children under 13 must be created and managed by a parent/guardian. SJFC will not knowingly collect personal info from children under 13 without verifiable parental consent.
14. Intellectual Property & Takedowns
All SJFC content is protected. For alleged infringement, submit a DMCA-compliant notice to SJFC’s designated agent. SJFC may remove content and terminate repeat infringers.
15. Dispute Resolution
15.1 Arbitration & Class Waiver
Except for small claims, disputes will be resolved by binding individual arbitration in St. Johns County, FL, under AAA Consumer Rules. No class actions. You may opt out within 30 days of acceptance.
15.2 Time Limit
Claims must be filed within one year or be forever barred.
16. Severability & Survival
If any provision is invalid, the rest remain enforceable. Sections on risk, waiver, indemnity, payments, IP, privacy, and dispute resolution survive termination.
17. Acceptance of Terms
By accessing or using the Websites, registering for, or participating in SJFC Activities, or allowing your minor child to do so, you confirm that you have read, understood, and agree to these Terms of Service.
SJFC reserves the right to update or amend this Terms of Service at any time. All members will be notified of any changes.
